Terms of Use

Last updated:

These Terms are the rules for using our website and ScreenSnap Pro, and the terms of the licence you get when you buy it. We have kept them as short and plain as we could. If you are a consumer, nothing in them takes away the rights the law gives you.

The short version

  • ScreenSnap Pro is a one-time purchase, sold through Polar, our reseller. One licence key works on 2 computers (Mac, Windows or one of each), never expires and includes all future updates.
  • You can use it for work, including client work, as well as for personal projects.
  • 30-day money-back guarantee. Email support@screensnap.pro within 30 days of buying and you get a full refund, no questions asked.
  • ScreenSnap Cloud links are public to anyone who has them. Don't upload anything illegal. Report abuse to support@screensnap.pro.
  • Portuguese law applies, but as a consumer you keep the protection of the consumer laws of the country where you live.

Who we are

ScreenSnap Pro is run by Iaroslav Morgunov, a sole trader (empresário em nome individual) established in Portugal. "We", "us" and "our" in these Terms mean him.

Our emails and parts of the website are signed "Morgan". That is the name we use in public; it is the same person and the same business. Our full business details are in the Legal Notice.

What these Terms cover

These Terms apply when you use:

  • our website, www.screensnap.pro, in any language, including our free online tools
  • the ScreenSnap Pro app for macOS and Windows (the "App")
  • ScreenSnap Cloud, the optional file hosting with share links at share.screensnap.pro
  • Website Capture, the App feature that takes a screenshot of a web page from its address

By using the website or the App, you agree to these Terms. When you buy a licence, they are the terms of your licence. Some sections only matter if you use that part of ScreenSnap Pro; the licence, for example, only applies once you have bought one.

These Terms don't cover sponsored article placements, which we agree separately with each advertiser.

A consumer is someone who buys or uses ScreenSnap Pro mainly for purposes outside their trade, business or profession. A business customer is anyone else. Where the rules differ, we say so.

Buying ScreenSnap Pro

ScreenSnap Pro is sold by Polar Software, Inc. ("Polar"), 3500 South DuPont Highway, Dover, DE 19901, USA, as our reseller and merchant of record, through Polar's hosted checkout. This means:

  • Your purchase is from Polar. The contract for the sale and the payment is between you and Polar, under Polar's Buyer Terms.
  • Your licence is from us. Your right to use ScreenSnap Pro comes from us, under these Terms.

For a problem with the payment itself, such as a double charge, write to us or to Polar at support@polar.sh.

Please download the App only from our website or our GitHub releases page. We can't vouch for copies from anywhere else.

Your licence

When you buy ScreenSnap Pro, we give you a licence to install and use the App on the terms below. You don't buy the software itself; you get the right to use it.

What you get

  • Perpetual. Your licence doesn't expire and has no recurring fee.
  • Non-exclusive, and not transferable, except where the law allows (see Passing on your licence, below).
  • Personal and commercial use. You can use the App for any lawful personal or professional purpose, including work for your employer or your clients. A business that buys a licence may let its staff use it, within the 2-computer limit.
  • 2 computers per licence key: two Macs, two Windows PCs, or one of each.
  • All future updates free. There are no paid upgrades.

The screenshots and recordings you make are yours. We claim no rights in them.

Activation and moving to another computer

  • Online activation. To activate, the App sends your licence key and an identifier derived from your computer's hardware ID to our licence server, which registers the activation with Polar. That is how the 2-computer limit works: the App won't activate on a third computer until you free a seat. The Privacy Policy explains what is sent and stored.
  • Moving a seat. Click Detach License in the App's settings on the computer you no longer want to use, then activate on the new one. If you can't reach the old computer (because it was lost, sold or broken, for example), email us and we will free the seat.
  • Offline use. Once activated, the App keeps working without an internet connection. It checks the licence again the next time it starts with a connection. ScreenSnap Cloud and Website Capture always need a connection.

What needs a licence

This is how the App works today. We may make more features available without a licence, but we won't put features you have paid for behind a new payment.

What you may not do

  • share, publish, rent or lend your licence key, sell it other than as allowed under Passing on your licence (below), or have it active on more than 2 computers at a time
  • get around the activation, the 2-computer limit or any other licence check, or help others do so
  • decompile, disassemble or reverse engineer the App, except as far as the law allows (for example, to make it work with other software) or an open-source licence permits (see below)
  • sell, rent or distribute modified versions of the App
  • use the App to break the law or other people's rights

You are responsible for what you capture and record. Respect other people's privacy and rights, and the rules on recording people, calls and copyrighted material that apply where you are.

Passing on your licence

You may not transfer your licence to someone else, except where the law allows it. If you do transfer it lawfully, detach it from all your computers first and stop using it, and let us know at support@screensnap.pro so we can help.

Open-source components

The App includes open-source software, including FFmpeg (licensed under the GPL-3.0-or-later) and Mediabunny (licensed under the MPL-2.0). These components come under their own licences, which are included with the App together with their notices. For those components, their licences take precedence over these Terms, and nothing in these Terms limits your rights under them. The source code of the FFmpeg build we ship is published next to the installers on our GitHub releases page.

Updates and launch at login

  • Automatic updates. About a minute after it starts, and then every 6 hours, the App checks GitHub for a new version. New versions download in the background and install when you quit the App. There is currently no setting to turn this off.
  • Launch at login. "Launch at Startup" is on by default, so the App starts when you log in to your computer. You can turn it off in the App's Settings.
  • What we promise. Updates are free for licence holders. We provide the updates needed to keep the App working as described, including the security updates the law requires, for as long as the law requires. We can't promise that the App will support every future version of macOS or Windows.

30-day money-back guarantee

If ScreenSnap Pro isn't right for you, you can get a full refund within 30 days of your purchase, no questions asked.

  • How. Email support@screensnap.pro within 30 days of buying. Write from the email address you bought with, or include your order number or licence key, so we can find your order. Any clear message that you want your money back is enough. You can also ask Polar for the refund.
  • What you get back. Everything you paid, including tax. The refund is processed by Polar and goes back to your original payment method. We issue it within 14 days of your request at the latest; how long it then takes to appear depends on your bank or card provider.
  • After the refund, your licence ends. Please detach it from your computers and stop using the features that need a licence. We may deactivate your licence key. Download any ScreenSnap Cloud files you want to keep before you ask for a refund; we may delete the uploads of a refunded licence.

Your right of withdrawal. If you are a consumer in the EU, the law gives you 14 days to withdraw from an online purchase. Our guarantee includes that right and extends it to 30 days. You can use it even after you have downloaded, activated and used the App, and you never need to give a reason.

This guarantee is given by Iaroslav Morgunov (see Who we are, above), covers ScreenSnap Pro, applies wherever you live, and comes in addition to your legal rights (see the next section), which it does not affect.

If you are a consumer, the App and ScreenSnap Cloud come with the legal guarantee of conformity under EU and Portuguese law (Decreto-Lei 84/2021). In short, they must work as described and as you can reasonably expect from this kind of software.

If something doesn't, tell us at support@screensnap.pro. We will fix it free of charge. If we can't within a reasonable time, or the problem is serious, you can ask for a price reduction or end the contract and get your money back. For the App, this covers problems that existed when you got it and show up within two years. For ScreenSnap Cloud, it covers problems during the whole time we provide it to you.

These rights come on top of the 30-day guarantee, and nothing in these Terms limits them.

ScreenSnap Cloud

How it works

ScreenSnap Cloud is optional, included with a licence at no extra cost, and off by default. Files are uploaded only when you click Upload, Share or Create Link, or if you turn on automatic upload. Each upload gets a share link (share.screensnap.pro/…), which the App copies to your clipboard.

  • Links are public to anyone who has them. There is no password or sign-in, and anyone you send a link to can pass it on. Only upload what you are comfortable with other people seeing.
  • Links don't expire. They keep working until you delete the upload in the App's Library, or we remove it as these Terms allow.
  • It is not a backup. Keep your own copies of files you care about. What happens to a file when you delete it is explained in the Privacy Policy.

We work to keep ScreenSnap Cloud running, but we can't promise it will always be available without interruption, for example during maintenance or an outage at one of our service providers.

Your files

You keep all rights in the files you upload. You give us a limited, non-exclusive, free licence to store and copy them (for example to make thumbnails) and to deliver them to anyone who opens their share link, only to run ScreenSnap Cloud. You confirm that you have the right to upload and share each file.

We don't look at your files, scan them or monitor what is uploaded. We look at a particular upload only if someone reports it, the law requires it, or you ask us for help with it.

What you must not upload or share

  • anything illegal, including child sexual abuse material, which we report to the authorities
  • intimate images of someone without their consent
  • malware, phishing pages or other files meant to deceive or cause harm
  • material that infringes someone else's copyright, trademark or other rights
  • content that harasses or threatens people, incites hatred or violence, or reveals someone's private information without a lawful reason
  • spam, or other bulk distribution of unsolicited material

If you break these rules, we may remove the file, disable its link and limit your use of ScreenSnap Cloud, as described in the next section.

Reporting illegal content

Our contact point for users and for authorities (including under the EU Digital Services Act) is support@screensnap.pro. You can write to us in English, German, Spanish or Portuguese.

To report a file shared through ScreenSnap Cloud, email us:

  1. the exact share link (or links)
  2. why you believe the content is illegal or breaks these Terms
  3. your name and email address (you may leave these out if you are reporting child sexual abuse material)
  4. a statement that you believe, in good faith, that the information in your report is accurate and complete

What happens next:

  • We confirm that we have received your report.
  • A person reviews it promptly and carefully. We don't use automated tools to decide on reports.
  • If the content is illegal or breaks these Terms, we remove it or disable access to it. We tell you what we decided.
  • Where we can contact the uploader (usually through the email address of their purchase), we tell them what we did, why, and how they can contest it.
  • Either of you can reply to ask us to look at the decision again. You can also go to court.
  • If a licence is used for abuse repeatedly, we disable ScreenSnap Cloud for that licence key.
  • If content suggests a criminal offence that threatens someone's life or safety, we inform the authorities.

Website Capture

Website Capture takes a screenshot of a web page from its address. It needs a licence. When you use it, our server passes the address and your capture settings to a third-party rendering service (ScreenshotOne), which loads the page in a fresh browser, without your cookies or logins, and returns an image to the App. We don't keep the image.

  • You are responsible for the pages you capture and for what you do with the images. Respect copyright, the website's own terms and other people's privacy.
  • Don't capture addresses that contain secrets, such as private access tokens.
  • Not every page can be captured: some sites block automated browsers, need a login or look different to a new visitor.
  • Don't use Website Capture for bulk scraping or in a way that overloads other websites. We may limit its use to prevent abuse.

Free online tools

Our online tools are free and need no account. They process your files in your browser; your files are not uploaded to us.

We may change, limit or remove any tool at any time. Check the results, such as converted files or recognised text, before you rely on them, and keep your originals. Please don't automate the tools. Your statutory rights are not affected.

Using our website

When you use our website, please don't:

  • use it to break the law or other people's rights
  • attack, overload or probe it, or try to get around its security
  • scrape it in a way that burdens our servers
  • pretend to be us or to speak for ScreenSnap Pro

Our guides are general information. We try to keep them accurate, but apps and operating systems change, so check before you rely on them. We are not responsible for the content of other websites we link to.

Intellectual property

The ScreenSnap Pro name and logo, the App (apart from its open-source components) and the text, images, videos and design of our website belong to us or to those who licensed them to us. You may quote short parts of our articles with a link to the source. Please don't republish whole articles, or use our name or logo in a way that suggests we endorse you, without asking us first.

Other product names on our website are trademarks of their owners. Mentioning them doesn't mean their owners endorse ScreenSnap Pro.

What you create with the App and what you upload stays yours. If you send us feedback or suggestions, you give us a free, non-exclusive, permanent licence to use them to improve ScreenSnap Pro. You don't give up any rights in them.

Changes to ScreenSnap Pro and to these Terms

Changes to the App and our services

We keep developing ScreenSnap Pro. We may add, change or remove features for a valid reason: to support new versions of macOS or Windows, to fix security problems, to follow the law, because one of our service providers changes or stops its service, or to improve the product. Such changes never cost you anything extra, and we won't remove the core functionality you paid for: capturing, editing and recording your screen on your computer.

ScreenSnap Cloud and Website Capture depend on our servers and on other providers. If we have to change them in a way that clearly makes them worse for you, for example by lowering the limits or closing a service, we will tell licence holders by email at least 30 days in advance, unless security or the law requires us to act sooner. If you are a consumer, you then have the rights Decreto-Lei 84/2021 gives you, including ending the contract for that service free of charge within 30 days.

Changes to these Terms

We may update these Terms for a valid reason, such as new features, changes in the law or security needs, and we change the date at the top when we do. Before a material change takes effect, we announce it on our website and email licence holders.

Changes never take away the core licence you bought: perpetual use on 2 computers with free updates. Your licence keeps the core licence grant it was bought under. For the website and the free tools, the version of these Terms in force when you use them applies.

Suspending or ending access

You can stop using ScreenSnap Pro at any time. You can uninstall the App and delete your ScreenSnap Cloud uploads in the App's Library.

We may suspend or end your licence, or your use of ScreenSnap Cloud or Website Capture, only if:

  • you seriously or repeatedly break these Terms, for example by publishing your licence key or uploading illegal content
  • your purchase is refunded or charged back
  • the law or a competent authority requires it

Unless it is urgent or the law forbids it, we will first tell you by email what we plan to do and why, and give you a chance to respond or put things right.

Liability

  • Without limit. We are liable without limit for damage caused intentionally or through gross negligence, by us or by people acting for us, for death, personal injury or harm to health, and wherever else the law doesn't allow liability to be limited.
  • Slight negligence. Otherwise, if we breach our contract with you through slight negligence, we are liable only if we breach an obligation that is essential to it (one that must be fulfilled for ScreenSnap Pro to work as agreed and that you can reasonably rely on), and only for damage that was typical and foreseeable when the contract was made.
  • Consumers. This section does not limit your statutory rights, including the legal guarantee of conformity described above and your right to compensation for damage caused by defects.
  • Business customers. In the case of slight negligence, our total liability is limited to the price you paid for your licence, and we are not liable for lost profits or other indirect losses, as far as the law allows.

The App saves your screenshots and recordings on your computer, and ScreenSnap Cloud is not a backup. Please keep your own backups of files that matter to you.

Age

To buy a licence you must be at least 18, or have a parent's or guardian's permission. Our website, free tools and App are not directed at children under 16. If you are under 16, please don't give us personal data, such as your email address.

Governing law and courts

  • These Terms, and any contract made under them, are governed by Portuguese law.
  • If you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts of Portugal or of the country where you live.
  • If you are a business customer, the courts of Porto, Portugal, have exclusive jurisdiction.

Complaints and out-of-court dispute resolution

If you are unhappy with anything, please write to support@screensnap.pro first, so we can try to put it right.

Complaints book. You can also complain through the Portuguese electronic complaints book, the Livro de Reclamações Eletrónico. We reply to complaints made there within 15 working days.

Consumer arbitration. If you are a consumer and we can't settle a dispute between us, you can take it to a consumer dispute resolution body:

For disputes worth up to €5,000, if you choose to take the dispute to a consumer arbitration centre, Portuguese law requires us to take part (Lei 24/96, article 14(2)).

Language

These Terms are written in English and translated into German and Spanish. If you are a consumer, each language version is equally valid. For business customers, the English version prevails.

Privacy

How we handle personal data is explained in our Privacy Policy and Cookie Policy. They are information for you, not part of our contract.

Other points

If a court finds part of these Terms invalid, the rest still applies. If we don't enforce a right straight away, we haven't given it up.
